THE CONTRACT:
The payment holder and / or the persons that appear in the reservation (hereinafter referred to as the client) will be subject to the conditions that follow. The payment of the reservation / service represents the acceptance of the following conditions.

PAYMENT:
Any bank charge is the responsibility of the customer. Check with your bank for transfer fees. Payment by credit card carries additional charges of 12% VAT (Ecuadorian tax) and 8% credit card charge. The most convenient way is online payment.

CANCELLATION BY THE CUSTOMER:
Any cancellation by a client must be made in writing attached an official national document of discharge or justification for which he requests the refund (medical part, invoice, etc). The date on which SUP Galapagos receives the email will determine the applicable cancellation charges. The cancellation charges below are a percentage of the total tour price, excluding insurance. It is strongly recommended to take out cancellation insurance at the time of booking.

A. Cancellation 45 days before departure date: loss of 50% of the total tour price
B. Cancellation 30 days or less before the departure date: loss of 100% of the total tour / service price (ticket)

UNUSED SERVICES:
There will be no refunds for unused services.

CANCELLATION OF THE TOUR BY SUP GALAPAGOS:
The agency reserves the right to cancel a tour for any reason, but will not cancel a tour less than 15 days before departure, except for unusual or unforeseen circumstances beyond the control of the agency. When a tour is canceled, the customer can choose between a refund of all money paid (except for payment charges) or any alternative tour offered in place of the agency.

FLEXIBILITY:
the client appreciates and recognizes that the nature of this type of trip requires considerable flexibility and should allow alternatives. It is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to modifications without prior notice due to local circumstances or events, which may include illness or mechanical breakdown, flight cancellations, strikes, events that arise from political disputes, entry or border difficulties, weather and other unpredictable or unpredictable circumstances.

CHANGES:
SUP Galapagos reserves the right to change any of the facilities, services or prices described before making a reservation. If such change is made, the customer will be informed at the time of booking. The customer can make a change in a confirmed reservation agreement only if it has been more than 60 days before departure. Additional costs incurred will be charged.

IF YOU PREVENT FROM TRAVELING:
the cancellation charges mentioned above are applicable regardless of the circumstance. It is strongly recommended to take out cancellation insurance at the time of booking that covers unforeseen circumstances.

ACCEPTANCE OF RISK:
The client acknowledges that the nature of the tour is adventure and that such vacations may involve a significant amount of personal risk.

CUSTOMER RESPONSIBILITY:
It is the client’s responsibility to inform us before booking if they have any special requirements, limited mobility or medical conditions that may affect their ability to participate in our tours. A reasonable level of fitness is required and if you have questions about the suitability of our tours, ask us. If there is any medical concern, it is the client’s responsibility to seek confirmation from their doctor before booking the trip. You may be asked to complete a medical form or submit a medical certificate before traveling.

ITINERARIES:
All itineraries are only a guide and are subject to modifications in the event of unpredictable conditions and circumstances that may arise in this deliciously chaotic continent. Any change does not have to be notified until the trip report before the trip.

AUTHORITY ON THE TOUR:
At all times, the decision of the Tour Leader of the agency will be final in all matters that may jeopardize the safety and well-being of the tour. If the client does not comply with the laws, customs, currency exchange and drug regulations of all the countries visited, the Tour Leader can order the client to leave the tour without any refund.

TRAVEL DOCUMENTS:
The client must be in possession of a valid passport and all visas, permits and certificates, including vaccination certificates. Ultimately, it is the client’s responsibility to ensure they have the necessary documentation.

FACTORS OUTSIDE OF SUP GALAPAGOS CONTROL:
The agency cannot accept any responsibility for matters beyond its control, such as political disputes, border closures, visa refusal, industrial action, delayed flights and unpredictable weather conditions that may prevent Follow the itinerary.

INSURANCE:

LOCAL CONDITIONS:
Due to political and cultural differences, as well as generally harsher physical conditions, traveling to the areas we visit involves risks other than those we take in our daily lives. RESPONSIBILITY:
Not all services in this document are organized by SUP Galapagos, since in many cases the agency is an intermediary of the services it presents. Notice is hereby given that all arrangements made on behalf of customers are made by the organizers with the sole condition that the organizers are not responsible for any injury, death, accident, delay, loss, damage or irregularity. SUP Galapagos acts as an agent of transport companies, hotels and other contractors and will not be considered reliable for any injury, damage, loss, delay or irregularity that may occur.

CLAIMS AND CLAIMS:

PRICES:

ACCEPTANCE OF MARKETING:
The client agrees to allow SUP GALAPAGOS to use any photo or video taken while on tour. SUP GALAPAGOS may use this content for promotional and marketing purposes. The client accepts that this content can be used in any medium that chooses SUP GALAPAGOS (both online and in print) and grants SUP GALAPAGOS an unconditional and royalty-free worldwide license for the use of this content.

PRIVACY POLICY:
SUP GALAPAGOS may use any information collected about the client to effectively operate the route or communicate special offers and marketing efforts directly with the client. Such information may also be disclosed to service providers, as well as to agents and partners involved in the operation of the tour.

DISPUTES:
Any legal dispute with customers or suppliers will be made in the mediation center of San Cristóbal or in the multicompetent courts of Galapagos, under Ecuadorian laws and with special character taking into account the Organic Law of Special Regime of Galapagos (LOREG) .
